The Affirming Official is the senior level representative from within each Organization Seeking Assessment (OSA) who is responsible for ensuring the OSA’s compliance with the CMMC Program requirements and has the authority to affirm the OSA’s continuing compliance with the specified security requirements for their respective organizations. (2) Affirmation content. Each CMMC affirmation shall include the following information: (i) Name, title, and contact information for the Affirming Official; and (ii) Affirmation statement attesting that the OSA has implemented and will maintain implementation of all applicable CMMC security requirements to their CMMC Status for all information systems within the relevant CMMC Assessment Scope." #cmmc #dod #cybersecurity

The Department of Defense (DoD) recently published a proposed rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to incorporate contractual requirements pertaining to the proposed Cybersecurity Maturity Model Certification (CMMC) 2.0 program. The new proposed rule is a significant development in the path toward finalizing the CMMC 2.0 program. Based on its current trajectory, the likelihood of a finalized CMMC 2.0 going into effect in 2025 is quite high. A new proposed DFARS rule was published on 5/30/2024 under DFARS Case 2024-D006, Procurement Technical Assistance Program This proposed rule would: ▶️ Implement section 853 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2024 (Pub. L. 118-31; 10 U.S.C. 4951). to amend the definitions of nonprofit organization and business entities at 10 U.S.C. 4951 for the Procurement Technical Assistance Program. ▶️ Modify DFARS clause 252.205-7000, Provision of Information to Cooperative Agreement Holders, to amend the definition of cooperative agreement holder by removing “private” from “a private, nonprofit organization” and adding a reference to 10 U.S.C. 4951 to update the definition of business entities. The is clause will continue to not apply to acquisitions at or below the SAT. But, the clause will continue to apply to acquisitions of commercial products (excluding COTS items) and to acquisitions of commercial services. Comments are due 07/29/2024. "The rule also lays out a three-year-long “phased rollout” of the CMMC requirements. By the end of the three-year rollout, DoD estimates... 65% of applicable contracts will require a “level one” self-assessment..." #CMMC 32CFR170 Final Rule is out. CMMC is real and will begin to appear in contracts once the corresponding 48CFR Rule is complete. "When CMMC requirements are applied to a solicitation, Contracting officers will not make award, exercise an option, or extend the period of performance on a contract, if the offeror or contractor does not have the passing results of a current certification assessment or self-assessment for the required CMMC level, and an affirmation of continuous compliance with the security requirements in the Supplier Performance Risk System (SPRS)6 for all information systems that process, store, or transmit FCI or CUI during contract performance. " #DIB https://lnkd.in/gPJWFqzW

This week I shared thoughts on the #threat of Chinese malicious cyber activity and the importance of #cybersecurity at a keynote speech to the Air Force Technical Applications Center in sunny Florida. During AFTAC's Cybersecurity Day, I encouraged DoD members and industry partners alike to go to NSA.gov to learn from some of the over 75 Cybersecurity Advisories we've published about the threat and what to do about it. We talked about threats like #VOLTTYPHOON and the tactic of #livingofftheland to access and operate in our networks. Products on NSA.gov offer ways to become a hard target by employing #zerotrust principles. We can't choose to not be targets, but we can and must choose to be HARD targets...
